What compensation will be available under a National Vaccine Injury Compensation Scheme?

We currently don't know what compensation will be available. It's important to understand that, currently, there is no vaccine injury compensation scheme in Australia. 

The purpose of this site is to gather support for a national campaign to advocate for reforms to the Covid-19 Vaccine Claims Scheme and the development and implementation of a National Vaccine Injury Claims Scheme.

What will the National Vaccine Claims Scheme look like? 

We currently do not know what the National Vaccine Injury Claims scheme would look like. We will advocate for the scheme to: 

  • undertake initial liability assessments and accept claims as early as possible;

  • support claimants with medical and like expenses, lost wages and gratuitous and domestic care from the outset so that they can have financial security and receive the medical care and support they need;

  • compensate claimants for pain and suffering and future lost earnings, if their injuries become permanent;

  • treat payments of lump sum lost earnings as compensation for the loss of the chance to earn income, rather than income itself, to ensure appropriate taxation treatment of the compensation;

  • have a clear framework for assessing pain and suffering damages;

  • publish all payments of pain and suffering damages in a deidentified manner to ensure transparency concerning these assessments; 

  • have an external right of review to an independent Court if claimants are not satisfied with decisions concerning their application or their offer of compensation.

When will the national scheme be up and running?

Firstly, we are in the very early stages of advocating for such a scheme. The information you provide and the interest you have registered assist us in showing the need for a national scheme.

Will compensation claims be retrospective?

As there is currently no scheme, we cannot comment on how any potential scheme would work. That said, we will be advocating for the scheme to accept retrospective claims. 

Is this about anti-vaccination? 

This organisation does not discuss the efficacy of vaccines. 

We are seeking the creation of a National Vaccine Injury Compensation Scheme to support those that have suffered vaccine harm. 

We encourage individuals to obtain medical advice when considering vaccinations.
